COVENANT OF MERCHANTS

  1. The Merchant authorizes Zomato to collect Net Sales and Tips (if any) from customers on the Merchant’s behalf.
  2. The Merchant agrees to permit customers to make payments for an order using Zomato Pay.
  3. The Merchant agrees to offer discounts to customers in line with the conditions outlined in the Form and these Terms.
  4. The Merchant allows Zomato to promote and provide discounts to customers on behalf of the restaurant.
  5. The Merchant will determine the discount through the Zomato Dashboard, which will be valid until deactivated by the Merchant.
  6. The Merchant shall not discriminate against, discourage, solicit, or refuse a customer from availing the discount or using Zomato Pay for payment.
  7. The Merchant agrees that if it applies a service charge at its restaurant, it will do so uniformly for all customers and will not discriminate in levying the service charge between a Zomato Customer and any other customer.
  8. The Merchant agrees not to provide any offers or discounts similar or lower than the agreed-upon discount directly to the customer or through any third party during its validity.
  9. The Merchant is obligated to extend the discount to all customers.
  10. The Merchant will not impose any additional charges, beyond the Net Sales, on customers paying the bill using Zomato Pay.
  11. The Merchant allows Zomato to deduct the commission from the Net Sales and transfer the remaining amounts to the Merchant following the payment settlement process outlined in the Form.
  12. The Merchant will ensure that all mandatory information regarding taxes, levies, and charges applicable to the bill is clearly visible to customers on the bill, as per applicable laws.
